Oklahoma Representative Charles Key, the author of Oklahoma’s
HJR 1003, dubbed the " Tenth Amendment Resolution",
calls on the federal government to follow the U.S. Constitution and stop
infringing on the rights of the State of Oklahoma. |
| The heading of the resolution
begins by reading: "A Joint Resolution claiming sovereignty under
the Tenth Amendment to the Constitution of the United States over
certain powers". |
| Key, of Oklahoma City, said he filed
House Joint Resolution 1003 because many federal laws violate the 10th
Amendment of the U.S. Constitution, which states the powers not
delegated to the federal government "are reserved to the states
respectively, or to the people.” |
| The Constitution lists about 20 duties
required of the federal government. "We, the people in the states,
created the federal government,” Key said. "They act like they
created us and we’re under their authority, and that’s really not
the case.” |
| The resolution states the federal
government should "cease and desist, effective immediately,
mandates that are beyond the scope of these constitutionally delegated
powers.” |
| When the resolution passes, the
Oklahoma Secretary of State is required to send copies of it to
President Obama, the U.S. Senate and House leaders, members of
Oklahoma’s congressional delegation and legislative leaders in other
states. |
